Law and Legislative Affairs Department is a
separate unit within the Secretariat of the Government of
Chhattisgarh. Department is headed by Hon'ble Law Minister.
Main work of this Department is drafting/vetting of bills
and ordinances, publication of Acts and Ordinances in the
Official Gazette. The procedure of legislation is regulated
by relevant provisions of the Constitution, Rules of
Business of the Government of Chhattisgarh and the Law
Department Manual. All rules, regulations, bye-laws,
notifications, orders etc., which any department of the
Government proposes to issue, is prepared by the department
concerned thereafter a draft is forwarded to the law
department for opinion as well as vetting. The draft is
examined by the law department with reference to its legal
validity and duly vetted draft is sent to the department for
further action such as publication in the Official Gazette
etc. This department is also responsible for the work in
connection with elections to Lok Sabha (Parliament) and
Vidhan Sabha (State Legislature) and matters ancillary
thereto, various works relating to administration of
Justice, Civil, Criminal and all administrative matters
concerning the judiciary is performed by the law department.
Opinion is given to various Departments of the Government on
any legal issue referred by them. Vetting of draft
contracts, agreements and MoU in which State Government is
party is also done by the law department. Secretary Law is
ex-officio Administrator-General, Official Trustee and
Law Department is administrative department for State Legal Services Authority, constituted under the Legal Services Authorities Act, 1987, Hidaytullah National Law University constituted under the Hidaytullah National University of Law, Chhattisgarh Act, 2003, Madhyastham Adhikaran constituted under the Chhattisgarh Madhyastham Adhikaran Adhiniyam, 1983.
This Department is also administrative department of Highcourt and deals with all matters between the Highcourt and the Government.
